These Terms & Conditions (“Terms”) form a legally binding contract between you (“Client,” “User,” or “You”), POCAD AC Services (“POCAD”), and Zul Spot LLC (“Zul Spot”), the exclusive creator and owner of the ClimaScore™ HVAC Health Evaluation Technology, the POCAD Platform software, and the POCAD iOS application (collectively, the “Platform”).

POCAD AC Services is a licensed user of ClimaScore™ for the purpose of enhancing HVAC service delivery. The Client receives only viewing access. No rights of ownership or use are transferred.
The POCAD Platform software — including its iOS application, web portals, APIs, databases, source code, and documentation — is owned by Zul Spot LLC and licensed to POCAD AC Services. The POCAD brand, logos, and visual identity are used under collaborative arrangement between the parties.
You are expressly prohibited from:
Any attempt to derive algorithmic behavior through repeated testing, sampling, data probing, or systematic experimentation is considered algorithmic inference and is strictly prohibited.
Violations may result in permanent termination, revocation of memberships, civil penalties, criminal prosecution under federal trade secret laws, and legal action from Zul Spot LLC for damages and injunctive relief. This clause survives the termination of your account indefinitely.
You are granted a limited, revocable, non-exclusive, non-transferable license to use the Platform solely for:

The Platform is strictly for residential customer convenience. No professional, diagnostic, or financial decisions should be based solely on Platform information.
If you use the POCAD iOS application, you acknowledge the following:
These Terms are entered into between you and Zul Spot LLC / POCAD AC Services only. Apple Inc. is not a party to these Terms and has no responsibility for the app or its content. The app is licensed to you on a limited, non-transferable basis for use only on Apple-branded products that you own or control.
Zul Spot LLC and POCAD AC Services are solely responsible for providing maintenance and support for the iOS application. Apple has no obligation to provide any maintenance or support services.
Zul Spot LLC and POCAD AC Services, not Apple, are responsible for addressing any claims relating to the application or your use of it, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims under consumer protection laws.
You acknowledge that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms with respect to your license to use the iOS application, and Apple will have the right to enforce these Terms against you as a third-party beneficiary.
The iOS app uses Apple Push Notification service (APNs) to deliver:
You may disable push notifications at any time via iOS Settings → Notifications → POCAD. Disabling notifications may cause you to miss important service reminders.
The iOS app offers optional Quick Login using Face ID or Touch ID. When you enable this feature:
To use the Platform, you must register an account by providing accurate information including your full name, email, phone number, service address, and (when required) proof of address. You are responsible for:
POCAD may require email verification and manual address verification (proof-of-residency document upload) before granting full Platform access. Accounts pending verification have limited access. POCAD reserves the right to refuse, suspend, or terminate any account.
The Platform is provided “AS IS,” “AS AVAILABLE,” and “WITH ALL FAULTS.”
You acknowledge that:
Neither POCAD nor Zul Spot guarantees accuracy, completeness, reliability, HVAC performance, system health, electrical safety, HVAC lifespan, warranty validity, failure prediction accuracy, or emergency detection. You accept full responsibility for verifying system conditions with a licensed POCAD technician.
To the maximum extent permitted by law, POCAD, Zul Spot LLC, and their owners, employees, licensors, affiliates, and partners are not liable for any damages, including but not limited to:
You agree to fully indemnify, defend, and hold harmless POCAD and Zul Spot LLC — including their owners, subsidiaries, affiliates, employees, agents, and licensors — from any claims, lawsuits, damages, liabilities, losses, costs, and attorney fees arising from:
This section is intentionally strict and survives termination forever.
ClimaScore™ is:
ClimaScore™ does not check refrigerant charge, electrical continuity, combustion safety, CO levels, duct leakage, static pressure abnormalities not entered by the technician, or mold activity.
You agree ClimaScore™ cannot be used to price a home or property, dispute other contractor quotes, establish value for insurance, claim warranty coverage, or claim negligence or misrepresentation by anyone. It is exclusively an informational tool licensed to POCAD, not a certified metric.
The AI HVAC Companion:
You agree NOT to remove access panels, touch electrical components, bypass float switches or safety sensors, handle refrigerants, modify wiring, enter unsafe attic or crawl spaces, attempt DIY repairs the AI suggests, or ignore burning smells, smoke, buzzing, or rattling sounds.
You agree NOT to use VPNs, proxies, or multiple accounts to bypass limits; input intentionally misleading data; abuse the AI with rapid or automated prompts; or treat the AI as a technician replacement. POCAD may suspend AI access for any suspicious activity.
Memberships (Starter, Essential, Comfort Shield, Elite, or any other tier offered) are activated by POCAD staff after request and payment verification. Memberships unlock features such as the AI HVAC Companion, Smart Maintenance reminders, priority scheduling, and discounts. Membership feature availability may change without notice.
Payments may be made by card via Stripe, by Zelle or bank transfer to the designated POCAD payment address, or — for eligible purchases made inside the iOS app — through Apple In-App Purchase. When you pay by card, your card details are entered directly with Stripe, our PCI-compliant payment processor; POCAD does not store full credit card numbers. For Zelle payments, after sending payment you may upload a screenshot or PDF receipt through the Platform, which is reviewed and marked Approved, Rejected, or Pending. For Apple In-App Purchases, Apple processes the transaction and manages billing and renewals under Apple’s terms.
Membership fees and platform access fees are generally non-refundable once activated, except as required by law or as expressly agreed in writing. Service-related refunds are governed by your POCAD service agreement, not these Terms.
Where POCAD offers memberships or other purchases through Apple In-App Purchase, those transactions are subject to Apple’s standard payment terms and Apple’s subscription rules in addition to these Terms. Auto-renewing subscriptions renew automatically until cancelled; you can manage or cancel them in your Apple account settings, and refunds for App Store purchases are handled by Apple. Card subscriptions processed through Stripe also renew automatically until cancelled and may be cancelled through your account or by contacting POCAD.
Smart Maintenance is a reminder system for scheduled HVAC care (filter changes, tune-ups, coil cleanings, drain line flushes, UV lamp replacement). It is not a real-time monitoring, sensor, or predictive failure-detection system. Reminders are calculated from technician inputs, service history, and time-based intervals. Missing a reminder does not constitute negligence by POCAD or Zul Spot LLC.
The Size Calculator provides a rough sizing estimate based on the values you enter. It is for informational purposes only. Actual equipment sizing must be performed by a licensed HVAC professional using a full Manual J load calculation. POCAD and Zul Spot LLC are not liable for decisions made based solely on Size Calculator output.
If your account has a referral code or referral link, you may share it with personal contacts. You agree not to spam, mass-distribute, or use deceptive practices to promote your referral link. Referral rewards (when offered) are subject to separate program rules, may be paid through the SMLL Token program (where available) or other forms determined by POCAD, and may be modified or discontinued at any time without notice.
The Platform logs activity necessary for security, support, and quality, including:
These records may be used for quality control, safety auditing, abuse prevention, legal defense, and membership verification. You consent to these logs by using the Platform. Details of how this data is handled are in the Client Portal Privacy Policy.
HVAC systems contain high-voltage electricity, pressurized refrigerant, heavy components, rotating fans, electrical capacitors, potential fire hazards, and condensate drainage risks.
Do not: run the system during electrical smells, operate it if sparks or smoke appear, leave water leaks unattended, allow mold odors to persist, or touch internal components without proper training. Turn off the system and contact POCAD for any safety concern.
You may request deletion of your account at any time by:
Upon verified request, POCAD will delete or anonymize your personal data within 30 days, except where retention is required by law, tax obligations, fraud prevention, or ongoing service contracts. Some technician work records and ClimaScore™ history attached to the property may be retained in anonymized form. Full retention details are in the Privacy Policy.
POCAD may terminate your account immediately, without refund, for:
Zul Spot LLC may revoke POCAD’s ClimaScore™ license at any time. If so, ClimaScore™ features may be removed instantly without compensation. You agree you will not seek damages for such removal.
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. All disputes must be resolved via binding individual arbitration:
Arbitration venue is the county where the serviced property is located, defaulting to Broward County, Florida if no service address applies. Arbitration decisions are final, binding, and enforceable.
POCAD and Zul Spot LLC may update these Terms at any time. Material changes will be announced on the login page and, where reasonable, communicated via email or in-app notice. Your continued use of the Platform after changes are posted constitutes acceptance of the new Terms.
